This “Program” is copyrighted by NSK Ltd. (hereinafter NSK) and is not for sale; it is licensed for use. Under the terms of this License Agreement, NSK grants the user usage rights to the “Program” in the country where downloaded (hereinafter the “Usage Agreement”). NSK assumes no responsibility for the installation, usage, or results of the “Program” or that these will meet user expectations.
1. Usage Rights
Use of the “Program”
For each download of the “Program”, the user may (1) use the “Program” on one machine, or (2) transfer the “Program” to a third party.
If the “Program” is transferred to a third party, this “NSK Program License Agreement” must also be transferred. The user may transfer the program to a third party provided that the transferee agrees to the “NSK Program License Agreement.” Once a third party has agreed to the agreement, the original user’s usage rights will end.
The user must NOT (1) transfer or use the “Program” in any way not specified by this License Agreement; (2) transmit the “Program” by e-mail, etc.; (3) duplicate, change, combine, or distribute the “Program”; (4) decompile, disassemble, reverse engineer, or adapt the “Program”; or (5) relicense, lease, or loan the “Program.”
2. Copyright
In all cases, the copyright for this software, documentation, etc. belongs to NSK.
3. Warranty
This program is provided as is with no warranty of any kind.
No program services such as upgrades, etc. will be provided.
The warranty specified above for the “Program” is in lieu of all other warranties, express or implied, and including those statutory warranties against defects, for merchantability, or of fitness for purpose.
4. Limitation of Liability
NSK is not liable for lost profits, indirect damages, extended damages, or damages that occur for extraordinary reasons, either foreseen or unforeseen.
NSK is not liable for claims for damage from a third party. The above Limitation of Liability also applies to claims for damage/loss against the “Program” developer who supplied the “Program” to NSK.
5. Other
The user may terminate this Usage Agreement at any time without notifying NSK. In this case, the user’s usage rights for the “Program” will be terminated.
NSK may also terminate this contract if the user violates this Usage Agreement. In this case, the usage rights for the program will be revoked, and the user must delete, destroy, or otherwise make unusable any copies of the software they possess.
